First Steps Home Study Program Agreement
Thank you for your interest in working together. Please read this information carefully.
The purpose of this Agreement is to set forth the details about working together so that we both are clear as to what each of our respective roles are and how our communication will take place so that our time will be positive, productive, and comfortable.
This Agreement is being made between Barbara Swiatkiwsky (“Coach”) and you (“Client”). We both legally agree to the following:
Program Description.
You have enrolled in the First Steps Home Study Program at the investment price of $597 AUD.
Your investment must be paid in full prior to accessing the course content.
The inclusions of your program are as outlined on the website:
Membership in my First Steps Home Study Program:
• 8 Training Modules - each with worksheet and 60 minute audio replay resource (recorded live)
• Members Area where the Training Modules can be accessed
• Done for You Templates
• client intake, postural assessment
• Bonus video resources so you can see step by step how I use these resources
Enrolment terms and conditions
1. Payment for Enrolments
You must pay in full when you enrol.
2. Program Completion Term
First Steps Homestudy has no completion date. You may work at your own pace. Access to resources will be guaranteed for 12 months after time of purchase.
3. Enrolment Cancellation
All registrations in all Barbara Swiatkiwsky programs and events and retreats are non-refundable.
4. Product Warranty (if applicable)
If any product that you receive with your enrolment is found to be faulty, our only obligation to you it to replace the faulty product within 10 business days of your written request and return of the faulty product.
5. Financial, legal and medical advice disclaimer
We make no representation and give no warranty to the accuracy or completeness of the information provided at or in relation to this Program and do not accept responsibility for any errors or inaccuracies in, or omissions from, the information contained therein. The information provided during or in relation to the program is for general purposes only and it does not purport to be comprehensive or to render specific advice. Nor should it be regarded as financial, legal or medical advice. If any information or advice that may constitute financial, legal or medical advice is given at or in relation to an event, such advice is not authorised by Barbara Swiatkiwsky and does not constitute financial, legal or medical advice given by Barbara Swiatkiwsky . This disclaimer does not purport to exclude any warranties implied by law which may not be lawfully excluded.
6. Intellectual Property
All material relating to the Program for which you are enrolling whether presented during, before or after the Program, is subject to copyright and other intellectual property rights. The copyright in all such materials remains the property of their owners and may not be recorded, used or reproduced, without the written permission of the copyright owner. You agree not to do anything, at any time that would infringe the intellectual property rights in such materials.
Group programs will be recorded and these recordings may be sold as stand alone programs in the future. By participating in any group program, event, retreat or coaching event with Barbara Swiatkiwsky you consent to having your voice recorded and these recordings sold at a later date. You also agree that there will be no financial or other form of compensation for you for this.
7. Confidentiality
We respect your privacy and must insist that you respect the privacy of other fellow participants. You agree not to disclose proprietary information, ideas, plans and trade secrets that are disclosed by other Participants in confidence, nor to violate the publicity, privacy or intellectual rights of any Program participant.
8. General
The laws of the state of Victoria govern this agreement. Should any part of this agreement be determined by court to be invalid or unforeseeable, the remainder of the agreement will be unaffected. This agreement may not be varied except with the written approval of Barbara Swiatkiwsky. All terms, conditions and warranties implied by statute that are excludable are excluded from this agreement. Such terms, conditions and warranties implied by statute that are not excludable are not excluded from this agreement but our liability for breach of such conditions and warranties implied by statute that are not excludable is limited to the total amount paid by you to Barbara Swiatkiwsky under this agreement.
